PESHAWAR: Peshawar High Court (PHC) Tuesday suspended the death sentence of an accused convicted by the military court and sought report from the defence ministry.
A two-member bench of the PHC, headed by Chief Justice Waqar Ahmed Seth, heard a petition of the accused Abu Bakar, resident of Hangu district.
The counsel for the accused told the court that his client was arrested in 2010. He said that the military court sentenced him to death in 2015 without any evidence against him. He argued that the military courts were established in 2015, while his client was arrested in 2010, saying that conviction of his client by the military court was violation of the constitution.
The high court suspended the death sentence of the accused and sought reports from defence and interior ministries.
