Following a meeting between Prime Minister Shehbaz Sharif and Chief Justice of Pakistan (CJP) Qazi Faez Isa, a pivotal decision has been made. This decision revolves around the formation of a commission aimed at investigating the serious allegations brought forth by judges of the Islamabad High Court (IHC). The concerned judges have expressed deep concerns regarding the purported interference of the country’s intelligence agencies in the workings of the judiciary.
Federal Law Minister Azam Nazeer Tarar, addressing the media post the crucial meeting, conveyed Prime Minister Shehbaz’s firm assurance to CJP Isa. It was emphasized that the independence of the judiciary remains paramount, with no compromises to be made. Minister Tarar underscored the federal government’s responsibility to ensure a transparent investigation, suggesting the involvement of a reputable retired judge to oversee proceedings under the Commission of Inquiry Act.
Minister Tarar also disclosed that a decision, in principle, has been taken to establish a commission. This decision is set to be officially addressed during the forthcoming federal cabinet meeting. The gravity of the situation was acknowledged, emphasizing the imperative need to investigate any form of external interference in institutional affairs.
The judges’ letter to the Supreme Judicial Council (SJC) highlighted critical lacunae in the existing code of conduct for judges. It emphasized the necessity for clear guidelines on reporting instances of intimidation and interference compromising judicial independence. The recent full court meeting of the apex court further underscored the urgency of addressing these concerns, with stakeholders demanding a thorough investigation into the matter.
The urgency for a comprehensive inquiry into the allegations gains further momentum with the support of bar associations and senior lawyers across various regions. The demand for a probe stems from the potential ramifications of unchecked external interference on the integrity and independence of the country’s judiciary.
