The case was heard by IHC Chief Justice Sardar Muhammad Sarfraz Dogar and Justice Muhammad Azam Khan. The matter had been pending since July of last year, following a previous reservation on the plea’s maintainability. During proceedings, a representative of the District Bar Association suggested the case be referred to the Islamabad Bar Council, arguing that allegations against a judge typically involve judicial misconduct and fall under the jurisdiction of the Supreme Judicial Council (SJC) under Article 209 of the Constitution.
Chief Justice Dogar clarified that the case concerns the “eligibility” of a judge, not misconduct, and is therefore maintainable under Article 199 of the Constitution. Previously, the Sindh High Court (SHC) had suspended the University of Karachi’s decision to cancel Justice Jahangiri’s law degree. This came shortly after the Supreme Court declared a separate IHC order barring him from judicial duties as null and void.
