ISLAMABAD: Former prime minister and founder chairman of Pakistan Tehreek-e-Insaf (PTI) Imran Khan has filed petition in the Islamabad High Court (IHC) against the cypher case, seeking acquittal and asserting the invalidity of the proceedings.
In the petition filed by PTI founder Imran Khan, the argument is presented that the proceedings from November 23 until now are deemed illegal.
The petition highlights that on December 12, the trial court dismissed their plea against the cypher case, contending that the trial court judge misinterpreted the term ‘complaint’ in Section 13(2)(3) of the Official Secrets Act.
According to the petition, the legal definition of the term ‘complaint’ is explicitly outlined in the law, which does not include the police officer’s report. Section 4(H) of the Criminal Procedure also provides a definition for the term ‘complaint.’
The petition further emphasizes that, according to the law, a complaint refers to an oral or written plea before a magistrate based on an allegation.
It is noted in the petition that the ongoing cypher case against the PTI Chairman relies on the First Information Report (FIR) and police report.
The petition adds that the Official Secrets Act is a specialized law distinct from general legislation, and adherence to legal procedures is imperative when applying the Official Secrets Act.
