ISLAMABAD: In a significant ruling, the Islamabad High Court (IHC) declared on Friday that the authority of Deputy Commissioner to make arrests under the Three-Maintenance of Public Order (3MPO) is illegal.
The case, involving the arrest of Pakistan Tehreek-e-Insaf (PTI) leaders Shehryar Afridi and Shandana Gulzar under 3MPO, was heard in the Islamabad High Court. Justice Babar Sattar, presiding over the case, delivered a pre-reserved judgment, granting the pleas of Shehryar Afridi and Shandana Gulzar against the MPO order.
The court emphasized that the Deputy Commissioner of Islamabad lacks the jurisdiction to issue 3MPOs, stating that this authority should be exclusively vested in the federal cabinet.
Consequently, the Islamabad High Court concluded the petition of Shehryar Afridi and Shandana Gulzar, declaring Section 18 of the 3MPO Act, 1980, as illegal.
