The Peshawar High Court has ruled in the cases of Umar Ayub, the opposition leader in the National Assembly, and Faisal Amin Gandapur, the brother of the Chief Minister and a member of the National Assembly, that individuals who have obtained transit or protective bail must surrender themselves to the respective courts within the stipulated time. Failure to do so will result in the cancellation of their bail.
The court further clarified in its judgment that transit and protective bail are limited to facilitating an appearance in the respective courts. Following this, it is within the jurisdiction of these courts to either grant pre-arrest bail, post-arrest bail, or refuse bail entirely.
Additional Attorney General Sanaullah argued in court that PTI members often disappear after obtaining transit and protective bail and fail to surrender to the relevant courts. He emphasized the need to address this issue in the context of the Peshawar High Court’s authority regarding protective bail.
